HAL is a 2nd party. This means that Nintendo does not own the company.

If they wanted to, HAL could leave Nintendo and make games for another console, much like what Bungie is currently doing to Miscrosoft.

Present > Kirby

Kirby is a character made by HAL. Though Ninendo may share copyrights over him with HAL, Kirby is HAL's character. This makes him seperate from Nintendo's characters(Mario, Link, DK, Samus..ect).

Kirby =/= Nintendo Character.

Due to the nature of the "Second Party", and due to the fact that companies such as HAL Labs are so closely tied to the main, first party branch, such as Nintendo, It can be said that Kirby is in fact a Nintendo character.

Kirby is a star in Nintendo's Super Smash Bros series, the tag-line on the of the original box? "Duke it out as your favorite Nintendo characters.

As you said before, Nintendo shares copywrites with HAL Labs, this mean that legally, Kirby is a Nintendo character!
